1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and SOMA Insights ("Company," "we," "us," or "our") governing your access to and use of the Sermon Brief platform, including any related services, features, content, and applications (collectively, the "Service").

By creating an account, accessing, or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.

2. Eligibility

To use the Service, you must:

  • Be at least 18 years of age
  • Be a resident of the United States
  • Have the legal capacity to enter into a binding agreement
  • Not be prohibited from using the Service under applicable law

By using the Service, you represent and warrant that you meet all eligibility requirements.

3. Account Registration

3.1 Account Creation

To access the Service, you must create an account by providing accurate, current, and complete information. You agree to update your information to maintain its accuracy.

3.2 Account Security

You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized access or security breach

You may not share your account credentials with any third party.

3.3 One Account Per User

Each user may maintain only one account. Creating multiple accounts to circumvent usage limits, trial restrictions, or for any other purpose is prohibited and may result in termination of all associated accounts.

4. Free Trial and Subscription

4.1 Free Trial

New users may be eligible for a 7-day free trial with the following terms:

  • Maximum of 4 briefs during the trial period
  • Valid payment method required at sign-up
  • Trial begins upon account creation

4.2 Automatic Billing

Upon expiration of the free trial (day 8), your payment method will be automatically charged for the subscription plan you selected. By providing payment information, you authorize us to charge your payment method on a recurring basis.

4.3 Subscription Terms

  • Subscriptions renew automatically at the end of each billing period
  • You may cancel at any time through your account settings
  • Cancellation takes effect at the end of the current billing period
  • You retain access to the Service until your current billing period ends

4.4 No Refunds

All subscription fees are non-refundable. When you cancel, you will not receive a refund for any fees already paid. Your access will continue until the end of your current billing period.

4.5 Price Changes

We reserve the right to modify pricing at any time. Price changes will be communicated in advance and will apply to the next billing cycle following notice.

5. Description of Service

5.1 What We Provide

Sermon Brief is an AI-powered sermon preparation tool that generates comprehensive preaching briefs based on Scripture passages. The Service includes:

  • AI-generated theological perspectives and commentary
  • Sermon outlines and application suggestions
  • Cross-references and exegetical insights
  • Customizable theological advisory team selection

5.2 AI-Generated Content Disclaimer

IMPORTANT: All content generated by the Service is produced by artificial intelligence. The "Theological Advisory Team" perspectives represent AI-synthesized viewpoints written in the style and theological tradition of named theologians. They are NOT actual quotes from these individuals.

The Service is intended as a starting point and study aid for sermon preparation. It is:

  • Not a replacement for personal Bible study, prayer, or seminary training
  • Not theological, spiritual, or professional advice
  • Not guaranteed to be accurate, complete, or error-free

You are solely responsible for reviewing, verifying, and adapting all generated content before use in ministry.

5.3 Citation and Attribution Requirements

When using content from Sermon Brief in written works, publications, academic papers, or public presentations, you are responsible for proper attribution. This includes:

  • Acknowledging AI-generated content - Do not present AI-generated material as entirely your own original work
  • Citing Sermon Brief as a source - When incorporating substantial ideas, outlines, or perspectives from generated briefs, cite "Sermon Brief (AI-generated)" or similar attribution
  • Academic integrity - Content from this Service should not be submitted as original academic work without proper disclosure and citation per your institution's policies
  • Transparency with congregations - We encourage transparency about the use of AI tools in sermon preparation as appropriate to your ministry context

Failure to properly attribute AI-generated content may constitute plagiarism under academic, professional, or ecclesiastical standards. You bear full responsibility for ensuring your use of generated content complies with applicable ethical standards and institutional requirements.

6. Acceptable Use Policy

6.1 Permitted Uses

The Service is intended for personal sermon preparation and ministry-related study by individual users.

6.2 Prohibited Uses

You agree NOT to:

Commercial Misuse:

  • Resell, redistribute, or commercially exploit generated briefs
  • Use the Service to build, train, or improve a competing product or service
  • Offer sermon writing as a paid service using our outputs

Content Misrepresentation:

  • Represent AI-generated content as human-written
  • Claim that AI-generated theologian perspectives are actual quotes from those individuals
  • Submit generated content as your own academic work (plagiarism)

Technical Abuse:

  • Use automated scripts, bots, or bulk generation tools
  • Attempt to circumvent usage limits or trial restrictions
  • Scrape, data mine, or extract theologian profiles, prompts, or system data
  • Reverse engineer, decompile, or attempt to derive source code
  • Interfere with or disrupt the Service's infrastructure

Harmful Content:

  • Generate content promoting hate, discrimination, or violence
  • Use the Service for any unlawful purpose
  • Generate content that defames or harms the reputation of named theologians

Account Abuse:

  • Share account credentials with others
  • Create multiple accounts to circumvent restrictions
  • Allow others to access the Service through your account

6.3 Enforcement

Violation of this Acceptable Use Policy may result in:

  • Warning or temporary suspension
  • Permanent termination of your account
  • Forfeiture of any remaining subscription period
  • Legal action where appropriate

7. Intellectual Property

7.1 Our Intellectual Property

The Service, including its design, features, code, algorithms, prompts, theologian profiles, and all associated intellectual property, is owned by SOMA Insights and protected by copyright, trademark, and other intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of the Service without our express written permission.

You retain ownership of any original content you input into the Service (e.g., sermon context, notes, or customizations you provide).

7.3 Generated Briefs

Subject to these Terms, you may use briefs generated through your account for your personal ministry purposes. You acknowledge that:

  • AI-generated content may have limited or unclear copyright protection
  • We make no guarantee of exclusivity (similar inputs may produce similar outputs)
  • You are responsible for your use of generated content

7.4 Feedback

Any feedback, suggestions, or ideas you provide about the Service may be used by us without obligation or compensation to you.

8. Data and Privacy

8.1 Privacy Policy

Your use of the Service is subject to our Privacy Policy, which describes how we collect, use, and protect your information.

8.2 Service Improvement

By using the Service, you agree that we may use anonymized and aggregated data from your usage to improve the Service, including AI model performance. We will not:

  • Use your identifiable sermon content without consent
  • Sell your personal data

8.3 Data Retention and System Validation

We retain all generated briefs, along with your name and email address, on our servers. This retention serves two purposes:

  • To allow you to access your brief history while your account is active

By using the Service, you acknowledge and consent to this retention for system validation purposes.

9. Disclaimers

9.1 "As Is" Service

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • Warranties of merchantability or fitness for a particular purpose

10. Limitation of Liability

10.1 Exclusion of Damages

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SOMA INSIGHTS, S CORP SHALL NOT BE LIABLE FOR ANY:

  • Indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, revenue, data, or business opportunities
  • Damages arising from your use or inability to use the Service
  • Damages arising from any content generated by the Service

10.2 Liability Cap

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify, defend, and hold harmless SOMA Insights, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Content you generate or distribute using the Service

12. Termination

12.1 Termination by You

You may cancel your subscription and close your account at any time through your account settings.

12.2 Termination by Us

We may suspend or terminate your account immediately if you:

  • Violate these Terms or our Acceptable Use Policy
  • Engage in fraudulent or illegal activity
  • Fail to pay subscription fees

12.3 Effect of Termination

Upon termination:

  • Your right to access the Service ends immediately (or at the end of your billing period for voluntary cancellation)
  • We may delete your account data after a reasonable retention period
  • Provisions that by their nature should survive will survive termination

13. Dispute Resolution

13.1 Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of law principles.

13.2 Informal Resolution

Before filing any legal claim, you agree to contact us and attempt to resolve the dispute informally for at least 30 days.

13.3 Jurisdiction

If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force and effect.

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision.

14.4 Assignment

You may not assign or transfer these Terms without our consent. We may assign these Terms without restriction.

14.5 Modifications

We may modify these Terms at any time. Material changes will be communicated via email or through the Service. Continued use after changes constitutes acceptance.
